J WALTER THOMPSON AUSTRALIA PTY LTD “JWT WOMB” PROMOTION
HOW TO ENTER:
1. To be eligible to enter, individuals must log on to www.jwtwomb.com website (“the Website”) and fully complete the registration form by the 31st August 2007, including nominating either J Walter Thompson (“JWT”) Melbourne or JWT Sydney as their preferred location to undertake an internship (“Participants”). Participants will also be given the opportunity to attend a workshop in either the JWT Melbourne or JWT Sydney offices on 12/09/07 in Sydney, and on 26/09/07 in Melbourne. These workshops are optional, although places will be limited.
2. Participants can access the JWT Womb Client Brief via the Website. Participants upon reviewing the JWT Womb Client Brief must produce a Creative Brief, and an advertising campaign proposal based on the JWT Womb Client Brief, for submission during the promotional period.
3. To enter, Participants who have completed a Creative Brief, and campaign proposal , must send via email to the address jwtwomb@jwt.com:

1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to Australian residents who are in their final year of tertiary study in any discipline at an Australian university, TAFE, an art institute or a vocational college, and who will have completed their studies and be available to commence full-time work in January 2008.
3. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.
4. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
5. The Promoter reserves the right, at any time, to verify the validity of entries and Participants (including a Participant’s identity, and place of residence) and to disqualify any Participant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
6. Incomplete, indecipherable or illegible entries will be deemed invalid. Only entries submitted via jwtwomb@jwt.com will be valid.
7. Only one entry permitted per Participant.
8. If there is a dispute as to the identity of a Participant, the Participant will be deemed to be the person who registered to participate in this promotion via the Website.
9. Promotion commences on 15/08/07. Entries close 11:59pm AEDST on 16/11/07.
10. The winners will be notified by email.
11. This is a game of skill and chance plays no part in determining the winner. Each entry will be individually judged based on the following criteria: idea development; creativity; innovation; design; and use of medium. The judges will select the best five (5) entries out of all entries received for JWT Melbourne and will also select the best five (5) entries out of all entries received for JWT Sydney. The ten (10) finalists will be announced on 26/11/07 via email. Each of the ten (10) finalists will be required to attend an interview and present their advertising proposal to a panel of judges at either JWT Sydney in the week commencing 1/12/07 or JWT Melbourne in the week commencing 8/12/07, with the time and exact date of the interview/presentation to be determined by the Promoter in its absolute discretion. In the event that one of the ten (10) finalists is unable to attend their interview/presentation, then that finalist’s entry will be deemed invalid, and the entrant who submitted the next best entry from those received for JWT Melbourne (if the invalid entry was from Melbourne), or from those received for JWT Sydney (if the invalid entry was from Sydney), will be invited to attend the interview/presentation. The judges will then determine, in their absolute discretion, the best entry received for JWT Melbourne and the best entry received for JWT Sydney (“the Winners”). The Winners will be announced on 15 December 2007. The Promoter’s decision is final and no correspondence will be entered into.
12. The Winners will each win a paid 9-month internship with the Promoter. The salary to be paid and the conditions applicable to each Winner will be determined by the Promoter in its absolute discretion. There will be one (1) x internship awarded, to be undertaken in the JWT Melbourne office, and one (1) x internship awarded, to be undertaken in the JWT Sydney office. As a condition of entering into this promotion, each Participant warrants that he/she will be available to commence their internship on the 15th January 2008 and agrees, subject to reviewing and accepting the terms and conditions of the contract, to sign a contract of employment with JWT.
13. Any and all costs, including travel and accommodation costs associated with a Participant attending any workshop, interview or presentation as part of the JWT Womb Program during the promotional period, shall be the sole responsibility of each Participant as incurred. The Winners will be required to pay any and all re-location, travel and accommodation and all other expenses incurred in order to commence and complete the nine-month internship.
14. All entries submitted become the property of the Promoter. Entries will not be returned to any Participant. As a condition of entering into this promotion, each Participant agrees to assign all of their rights, title and interest (including copyright) in and to their entry to the Promoter, with the exception of any materials specified in the Participant’s entry as belonging to a third party. Participants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
15. As a condition of entering into this promotion, each Participant warrants that he/she is the sole owner of the material provided in their entry into this competition with the exception of any materials specified in the Participant’s entry as belonging to a third party, and therefore has the right to assign any and all intellectual property rights to the Promoter to use this material in all media worldwide in perpetuity with no other compensation payable to the Participant (other than the prize provided herein). Each Participant also warrants to the Promoter that all of the material submitted in their entry, with the exception of any materials specified in the Participant’s entry as belonging to a third party, is the original work of the Participant which does not infringe the rights of any third party. Where the Participant has reproduced images/photographs or other materials belong to a third party as part of their entry into the competition, as a condition of entering into this promotion, each Participant warrants that he/she has identified these materials in his/her entry and has obtained any necessary approvals to reproduce any images, photographs or materials used. The Participant also agrees to indemnify the Promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition.
16. Participants consent to the Promoter using the Participant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
17. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Participant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
18. Any costs associated with accessing the promotional website is the Participant’s responsibility and is dependent on the Internet service provider used. Any and all costs associated with the preparation and submission of an entry are the sole responsibility of the Participant as incurred.
19. Liability for any tax (other than FBT) arising out of participation in this promotion (including acceptance of a prize) is the sole responsibility of the entrant. Participants should seek independent financial advice in this regard.
20. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a Winner or Participant; or (e) attendance at any of the JWT workshops, interviews or presentations or (f) redemption and participation in the prize.
21. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties including but not limited to the Client featured in the JWT Womb Client Advertising Brief. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the Participant. Participants should direct any request to access, update or correct information to the Promoter.
